from the bottom of my heart.

You do not know how happy you have made so many women for your willingness to stand by us and let us have this court fight we deserve.

There is nothing to lose and so very much to gain.

You set the wheels in motion for the ERA to finally be put in the Constitution.

President Biden’s official notice to the nation today follows clearly established precedent dating back to President Adams in 1798. The ERA is a valid part of our Constitution.

of the DOJ over Senator Gillibrand.

There was no deadline for ratification for the 11th Amendment as there is for the ERA.

But her opinion really doesn't matter, whereas the DOJ's opinion does.

Of course it can be fought, but courts have already established that the time limit on ratification was legally valid, and the time limit wasn't met. There is also the question of the states that rescinded their ratification, and whether or not they were legally able to do so. That will have to be settled as well.

Much more complicated than the 11th Amendment.

But there is a valid question of ratification that needs to be addressed, and the DOJ has addressed it.

Congress set a deadline, extended that deadline, and then the deadline passed without the requisite number of states having ratified the amendment.

There are valid, legal questions around whether or not a) Congress acted within the bounds of the Constitution by setting the deadline to begin with and b) whether or not states who rescinded their ratifications can be included as having ratified the amendment.

These are questions for the courts, not the President...

I'm thrilled President Biden has affirmed the Equal Rights Amendment as the law of the land, guaranteeing all Americans equal rights and protections under the law regardless of their sex.

The executive branch doesn't have a direct role in the amendment process, and Biden is not going to order the archivist to certify and publish the ERA, the White House told reporters on a conference call. A senior administration official said that the archivist's role is "purely ministerial" in nature, meaning that the archivist is required to publish the amendment once it is ratified.

In response to an NPR question about whether the archivist would take any new actions, the National Archives communications staff pointed to a December statement saying that the ERA "cannot be certified as part of the Constitution due to established legal, judicial, and procedural decisions."

"This is a long-standing position for the archivist and the National Archives. The underlying legal and procedural issues have not changed," the archives' statement said.
