The FBI on Friday arrested Milwaukee Judge Hannah Dugan, accused of helping a man evade immigration authorities, escalating a clash between the Trump administration and the judiciary over the Republican presidents sweeping immigration crackdown.

FBI Director Kash Patel issued a public statement on X, which he hurriedly deleted, making unsubstantiated claims about Judge Dugans case before charges were officially filed and she could have her moment in court. Director Patels statement shows that Trumps FBI is more concerned about weaponizing federal law enforcement, punishing people without due process, and intimidating anyone who opposes those policies, than they are with seeking justice.
I am extremely concerned about the Trump administrations continued intention to instill fear and hostility across our community. My office will continue to seek legal clarity as this alarming situation evolves ...

Federal law enforcement coming into a community and arresting a judge is a serious matter and would require a high legal bar. I will be following this case closely and facts will come out, however, I am very alarmed at the increasingly lawless actions of the Trump Administration, and in particular ICE, who have been defying courts and acting with disregard for the Constitution ...

(8,111 posts)According to the arrest affidavit for the judge, he had already been deported once, in 2013
and he was in court for some what sounds like serious allegations, the victims (plural) were in court to testify at the hearing which was apparently never held
This whole case sounds like a legal mess

That prompted Milwaukee County Circuit Judge Marisabel Cabrera to say in a later email to the other judges that her understanding was that ICE agents had presented an administrative warrant, not a judicial warrant ...
"A judicial warrant is issued by a federal court based on probable cause and permits law enforcement to enter premises that are not public and search to seize property or arrest someone subject to the protections of the 4th Amendment," said Daun, who previously served as Milwaukee County's chief legal officer.
"You do not need to open the door or permit entry or a search when presented only with an ICE or so-called 'immigration' warrant," she said ...

But the Trump administration hadnt gone so far as to actually arrest a sitting judge until now. NBC News reported:
.....Shortly after Dugan was taken into custody, Kash Patel, Trumps highly controversial FBI director, published a tweet that effectively spiked the football. We believe Judge Dugan intentionally misdirected federal agents away from the subject to be arrested in her courthouse, Eduardo Flores Ruiz, allowing the subject an illegal alien to evade arrest, he wrote in a missive that was deleted a short time later. Thankfully our agents chased down the perp on foot and hes been in custody since, but the Judges obstruction created increased danger to the public.
Democratic Sen. Tammy Baldwin of Wisconsin didnt quite see it that way.
In the United States, we have a system of checks and balances and separations of power for damn good reasons, the senator said in a statement. The presidents administration arresting a sitting judge is a gravely serious and drastic move, and it threatens to breach those very separations of power. Make no mistake, we do not have kings in this country, and we are a democracy governed by laws that everyone must abide by. By relentlessly attacking the judicial system, flouting court orders, and arresting a sitting judge, this president is putting those basic Democratic values that Wisconsinites hold dear on the line."

And were sending a very strong message today: If you are harboring a fugitive, we dont care who you are. ... We will come after you and we will prosecute you. We will find you......
Through her legal counsel, Dugan issued a statement Friday afternoon that read, Judge Hannah C. Dugan has committed herself to the rule of law and the principles of due process for her entire career as a lawyer and a judge. She has retained former United States Attorney Steven Biskupic to represent her. Judge Dugan will defend herself vigorously and looks forward to being exonerated. This will be the extent of any statements or interviews at this time.
