And while we might not yet know all the details, it's pretty clear this is an escalated attack on due process. This is a big step toward fascism.

For some reason everyone, including the judge, is ignoring the real victim

Judge Dugan has not done anything to warrant an arrest. ICE, however, and our FBI, have crossed the lines of legality.

(12,663 posts)Given that the outcome of an ice arrest could be being sent to a concentration camp in a foreign country, people of good conscience are being forced to make choices -- obstruct ice actions if they can or live with the knowledge that you stood by while someone was sweep into a system being run by a lawless regime.
My sister used to teach in Oakland, CA public schools. People who are still there are putting together strategies for protecting students and parents from ICE. And they all know they could end up in jail. It is a matter on conscience.
I am sure her former colleagues are not alone.
If the 47 regime had any interest in beefing up enforcement against undocumented people commiting crimes, they would afford people the due process they are owed. In denying rights, they are forcing Americans of good will to take a path of civil disobedience to prevent the blatant violations.
I hope that this case results in an injunction against the appalling "guidance" empowering ice to invade court rooms. More on that here:

(3,511 posts)None of the alleged victims will see justice, nor will the alleged perpetrator get justice. ICE barged into a legal proceeding in a courthouse and flushed everything down the toilet. There was no way that the alleged perpetrator was going to have his day in court after that.
What part of due process do you not understand?

The charge was there but there was no trial. Isn't it innocent until proven guilty?
I'm no fan of dv but this isn't right and you know it. He has the right to face his accuser in court and she has the right to pursue justice. This right was taken away when ICE entered the court room to deport him. That's what should make everyone furious right now.

(12,663 posts)Allowing ICE to take people into custody who are simply appearing in court as part of a civil matter, criminal matter, or a check in or adjudication of a case related to an asylum petition should be appalling to anyone who believes in the rule of law. Implicit in that belief is the principle that all incentives should be in favor of encouraging people to comply with the law. If you claim to believe in the rule of law but are in favor of forcing people into a catch 22 of following the law and appearing and risking being unlawfully sent to a foriegn prison for life or violating an appearance order, then I submit you really don't care about the rule of law.
Turning courthouses into ICE playgrounds is appalling. Period. I hope this case results in an injunction on the appalling guidance.

What facts do you know regarding the timeline of events inside the courtroom that day that we do not?

(1,517 posts)With an administrative warrant, you can't enter a private place or a place where there is a expectation of privacy such as courtroom without consent. Very important distinction. For example, if somebody came to your house to search your place without a judicial warrant, would you consent to that? Also, they could have waited until after the hearing, or better yet, tell the chief judge or whoever is the main person there well in advance. Heck, the courtroom opened at 8:15 am, so I doubt the judge could have had enough time to get to him in the docket. Also, perhaps you should ask the local/state police if he was arrested, particularly in regards to the serious charges against them. Normally, you would have a bail or some type of hearing. It sounds like there wasn't.
