Johnson Says Congress Must Address Birthright Citizenship After SCOTUS Loss

Source: Newsweek

Published Jul 05, 2026 at 01:52 PM EDT updated Jul 05, 2026 at 03:20 PM EDT

House Speaker Mike Johnson said Sunday that Congress must take up the legislative fight over birthright citizenship after the Supreme Court struck down an executive order by President Donald Trump that sought to restrict the practice.

The comments by the Louisiana Republican signal that party leaders are pivoting to a new legislative strategy following one of the most significant legal defeats of Trump’s second term.

Johnson argued that lawmakers should act after the high court's 6-3 decision preserved automatic citizenship for children born on U.S. soil, regardless of their parents' immigration status. Speaking on Fox News Sunday, Johnson claimed the current system is being abused through "birthright tourism" and suggested the House would move quickly if a legislative path is viable.

"Justice [Clarence] Thomas explained that the 14th Amendment, the original intent, was to enhance and really value citizenship," Johnson said. "And it's been devalued because of birthright tourism, which is what we have now. It's a threat to the rule of law and national security. We do need to address it."

Republicans want to rip up the Constitution and instead govern through the whims of Mad King Donald.

Legislation won’t change that. And it won’t matter much anyways, because what you and Lardass and the rest of the criminal regime are doing to our country, nobody will want to be a citizen of the shit hole you’re creating.

Johnson and Thomas are cut from the same disingenuous mold. They know what they're saying isn't true, but they have to tow the trump line.

You have no control over the Constitution, little man. Sit down, and shut up.

Supreme Court strikes down Trump’s order ending birthright citizenship

It is 6-3.

The Kavanaugh thing keeps confusing people but from the link -

Justice Brett Kavanaugh agreed with the result that the court reached – that the president’s executive order is invalid – but not its reasoning. In his view, Trump’s order “does not violate the Fourteenth Amendment” but does violate a federal law providing that children who are “born in the United States, and subject to the jurisdiction thereof” are U.S. citizens. Congress, Kavanaugh suggested, “could amend” that law “or otherwise enact new legislation establishing exceptions to birthright citizenship for children born to foreign citizens unlawfully or temporarily in the country. But,” he noted, “Congress has not yet done so.”

He nitpicked some law that the EO violates. It was to give fodder to Mikey and his merry band of MAGat loons, to try to legislate around the 14th Amendment.

Nevertheless, that's still five justices upholding birthright citizenship on constitutional grounds. To uphold legislation, Barrett would have to reverse herself.

And Alito, Thomas, and Gorsuch are just black-robed traitors.
