Todd Blanche is not explicitly required to undergo a Senate confirmation hearing to remain in his current role, but his legal authority to act as Attorney General faces a critical deadline on October 29, 2026.Under the Federal Vacancies Reform Act (FVRA), an acting official can only execute the duties of a vacant, Senate-confirmed position for a maximum of 210 days from the date the vacancy occurred. Because Blanche took over following the dismissal of Pam Bondi in April 2026, his initial 210-day clock expires just five days before the 2026 midterm elections.
*rump has three legal path options to address this timeline:
1- Submit a Permanent Nomination: If *rump formally nominates Blancheor anyone elseto the permanent position of Attorney General before October 29, the 210-day clock is immediately paused. Blanche would then be allowed to stay on as Acting Attorney General for the entire duration that the nomination is pending and being reviewed by the U.S. Senate.
2- Bypass with a Loophole:
Legal experts note that *rump could potentially keep Blanche atop the Justice Department indefinitely without ever triggering a confirmation vote. By using a statutory loopholerecently modeled by the Biden Administration's extended use of Julie Su as Acting Labor SecretaryBlanche might rely on DOJ-specific succession rules. Because the Senate already confirmed him 5246 as Deputy Attorney General in March 2025, proponents argue he is legally insulated to run the department for the remainder of the *resident's term.
3- Name a Different Successor:
If no permanent nomination is sent to the Senate and no succession loophole is utilized by October 29, Blanche must step down, and the administration will have to assign a new acting head.
