8. Even if it is enforced, it does not allow him to "do tax crimes" (present tense).

The "settlement" draws a line in the sand and purportedly protects him from being audited, etc. for acts which occurred before the settlement date - not for acts which occurred after. So if he is "doing" tax crimes now, the settlement doesn't protect him.
