The article describes him as a "state Supreme Court Judge" but you have to remember that, in New York, the term "Supreme Court" is perversely used to describe the trial court, not the highest appellate court.

Justice Breslin serves on the Supreme Court, Albany County, which means he would sit on cases originating in Albany County. Any criminal action against Trump would likely be brought in New York County (i.e., Manhattan).
