But her opinion really doesn't matter, whereas the DOJ's opinion does.

Of course it can be fought, but courts have already established that the time limit on ratification was legally valid, and the time limit wasn't met. There is also the question of the states that rescinded their ratification, and whether or not they were legally able to do so. That will have to be settled as well.

Much more complicated than the 11th Amendment.
